Catholic Institute for deaf people - whats new

Catholic Institute for deaf people - whats new: "Globally, many Deaf citizens encounter the general population’s perception of being Deaf as one of disability. This “disability mindset” contributes directly towards the exclusion and devaluation of all people who are considered “different” including those who are Deaf. As a result, Deaf citizens in many countries are still hindered and "excluded" from participation in the larger society. Many are prevented from equal access to decision making, employment opportunities, and quality education"?

Hypothermia death: Calls to switch on heat ‘ignored’ | Irish Examiner

Hypothermia death: Calls to switch on heat ‘ignored’ Irish Examiner: "She said Ms Peavoy made numerous complaints to the council and the family had contacted local Fianna Fáil TD Noel Ahern who claimed he had sent letters to the council"?So lawyers for dublin city council tried to have evidence from friends of Rachel Peavoy excluded at her inquest. The councils law officer tried to do this by quoting the"LAW"under section 30 of the coroners act, part of that act is "how"did a person die.It would be my contention that Rachel died because of a form of abuse by someone who had the power or authority to sort out the complaint that Rachel brought to their attention on many occasions as did her friends and neighbours. On the subject of abuse(which comes in many forms)a retired Garda wrote a book"Breaking the silence"in which he is quoted as saying those who presided over the carnage are still in power, that victims were let down by "Every System"the health service, the church, the gardi, etc. So now that we will have a new government in the next couple of weeks it will be interesting to see what kind of change they propose to bring about in relation to the questions put to the political leaders by the irish daily mail on my behalf about Rachael's case. Our new leader Enda Kenny said"I was shocked at what happened and will be raising it with members of the council. It is not acceptable that a young mother can die in that way this year.Eamon Gilmore said the case of Rachel Peavoy was truly shocking ,labour has been campaigning for years for a proper fuel poverty strategy.Gerry Adams said it is an absolute outrage that a woman found dead in ballymun last year died of hypothermia because she had no heating. There are many people and communities who have already been so badly served by the political elite.unquote.My wife actually wrote a book(unpublished)called"The Despair Of Silence)so it will be interesting to see what happens to all the promises about restoring the freedom of information act, accountability, transparency, openness, etc, etc. The Reasons Project?

The kind of Ireland the heroes of the Rising aspired to was based on an inclusivity that, famously, would ‘[cherish] all the children of the national equally – oblivious of the differences – which have divided a minority from the majority in the past’. That culture of inclusion is manifestly a strong contemporary impulse, working its way today through relationships with the North, with unionists, with the newcomers to our shores, with our "marginalised", and with our own increasing diversity. For many years, the social agenda of the Rising represented an unrealisable aspiration, until now that is, when our prosperity has created a real opportunity for ending poverty and promoting "true equality of opportunity" for our people and when those idealistic words have started to become a lived reality and a determined ambition"?

Apparently, as I am informed, before the punishment was inflicted, the doors were locked, the windows closed and the punishment, which was the normal punishment, was inflicted in the presence of all of his classmates. The punishment, I am informed, consisted [947] of a number of slaps on the hand from the punishment leather that is generally used for that purpose, but on the completion of that punishment the boy was ordered to submit to further punishment with the edge of the strap and he refused to accept that punishment. It begins by briefly setting out the development of variable standards of reasonableness review in the English law; the adoption of reasonableness by the Irish courts and their initial hesitance to adopting variable standards, before then going on to consider more recent cases which appear to evince an openness to this approach. This article also considers whether or not this departure from rigid reasonableness has come too late to make any real difference, given the potential supplanting of reasonableness with proportionality review"?POLITICAL AND LEGAL REFORM?

SSRN-The Death of Socio-Economic Rights by Paul O'Connell

SSRN-The Death of Socio-Economic Rights by Paul O'Connell: "Over the last decade apex courts in Canada, India, and South Africa – which have traditionally been viewed as progressive and broadly socio-economic rights friendly courts – have issued judgments that are, fundamentally, at variance with the meaningful protection of socio-economic rights. Drawing on the experiences in these three countries, and others, this paper will argue that this jurisprudential turn can be understood as a de facto harmonisation of constitutional rights protection in the context of neo-liberal globalisation. The various national courts, although dealing with idiosyncratic domestic constitutional provisions, have nonetheless articulated analogous conceptions of fundamental rights; which are atomistic, “market friendly” and more broadly congruent with the narrow neo-liberal conception of rights, and consequently antithetical to the protection of socio-economic rights"?THE REASONS PROJECT?

William Fry - Publication - Prevention of Corruption Legislation Enhanced

William Fry - Publication - Prevention of Corruption Legislation Enhanced: "The legislation’s most significant provisions relate to “whistleblowers”. Protection for whistleblowers was introduced in the UK by the Public Interest Disclosure Act 1998, but until now there has been no similar legislative protection in Ireland for whistleblowers. Under the new Act, where a person believes that a corruption offence has been committed and he reports that opinion, he will be protected against actions for damages and other relief unless he knew that, or was reckless as to whether, his opinion was false or vexatious. Whistleblowers must report their opinion to an appropriate person, the list of whom includes a member of An Garda Síochána, the whistleblower’s employer and any “confidential recipient” appointed by the Garda Commissioner to receive such communications in confidence. Where the whistleblower’s opinion is reported to a confidential recipient, his identity will (with some exceptions) be kept confidential. Employers are also prevented from penalising employees who have reported, or intend to report, corruption offences and the new legislation sets out a redress procedure for such employees."?

It is a strict liability offence and the only defence available is to show that the organisation had adequate procedures in place to prevent bribery. The Act therefore encourages businesses to have an anti-corruption policy in place. Finalised guidance on what constitutes “adequate procedures” was initially intended to be published by the Ministry of Justice in early 2011 but may now be delayed. The Ministry of Justice has stated that the Act will not come into force until three months after any guidance is published"?

History that wouldn't go away - The Irish Times - Sat, Feb 05, 2011

History that wouldn't go away - The Irish Times - Sat, Feb 05, 2011: "In fact we are now paying the price for a tradition of clientelist politics that stretches back far beyond the foundation of the modern Irish state. When we think of corruption there is a tendency to assume that it began with Charles Haughey in the 1960s, and certainly the Haughey era raised the politics of cute- hoorism and cronyism to an unprecedented level. But go back as far as the Act of Union, in 1801, and we find that this crucial legislation binding Britain and Ireland together was only passed into law by the expedient of massive bribery. Kickbacks and clientelism were an essential part of the fabric of 19th-century politics."?
