Now, one argument made is that Judgment was given when the special position of the Catholic church was recognised constitutionally and, since it’s removal, the Judgment is no longer of such strength in terms of jurisprudence. However, the Supreme Court has held that that particular, now removed, provision of the Constitution had never any Constitutional effect. NAMA vs OCEI – The Story

NAMA vs OCEI – The Story: The core of the argument comes down to legislative interpretation. Myself and Fred Logue (who has kindly given his free time to give huge help on the matter) have argued that the “and includes” part of the legislation when referring to public authorities really does mean “and includes”. NAMA have argued that it effectively means “may include”.
The Commissioner for Environmental Information, Emily O’Reilly, agreed last September with our view. She noted:
The National Asset Management Agency has argued that allowing the word “includes” its ordinary meaning would have the consequence, in the present context, of extending the definition of public authority beyond what is envisaged in the EU Directive. What NAMA proposes is that the plain and ordinary meaning of the word, as used in the Regulations, be set aside in favour of a meaning which implies a restriction rather than an expansion or an inclusion. It is not at all clear that, as Commissioner for Environmental Information, I may abandon the plain language of the Regulations in favour of an interpretation which is arguably more in keeping with the provisions of the Directive. This is particularly the case where the language of the Regulations, in this particular instance, is neither obscure nor ambiguous.?

The money was just resting in my account… | The University Times

The money was just resting in my account… | The University Times: Why do you think previous anti-corruption legislation has failed so miserably? We’ve had anti-corruption legislation in the past but it hasn’t really stopped anybody such as Senator Callely and the expenses scandal that erupted there.
Well the legislation wasn’t always necessarily there. The ethics act was brought in in 1995 but before that anti-corruption legislation in Ireland dated back to British statues of 1916 and 1906 so we had a very outdated legislative framework. I think there is a focus on the letter of the law rather than the spirit of the law which means the law always has to play catch up because there are always loopholes to be found when people only define their behaviour on what’s legally expected of them and not necessarily what their own moral obligations as servants of the public trust is. I think were coming to the point now where people are beginning to define their behaviour and realise that there’s not only legal expectations of them, but also moral expectations. It’s interesting in resignation speeches of a Ceann Comhairle or a Taoiseach or a former minister you see this phrase that crops up a lot: “I broke no law, I did no wrong.”?

Machholz's Blog | The Truth is out there !: The key to its success was the fast circulation of scrip within the local economy, 14 times higher than the Schilling. This in turn increased trade, creating extra employment. At the time of the project, unemployment in Wörgl dropped while it rose in the rest of Austria. Six neighboring villages copied the system successfully. The French Prime Minister, Eduoard Dalladier, made a special visit to see the ‘miracle of Wörgl’. In January 1933, the project was replicated in the neighboring city of Kirchbuhl, and in June 1933, Unterguggenburger addressed a meeting with representatives from 170 different towns and villages. Two hundred Austrian townships were interested in adopting the idea. At this point the central bank panicked and decided to assert its monopoly rights by banning complementary currencies?

But he can introduce a Bill and say to these Circuit Court judges and district justices that their remuneration can be cut. The fact that the President is seeking to put the Executive of the day in a position to cut the remuneration of certain judges, while not being in a position to cut the remuneration of other judges, is a most serious anomaly and, it seems to me, is calculated to demonstrate that the Legislature and the Executive Council do not regard Circuit Court judges and district justices as being entitled to the same measure of independence from the point of view of exercising their normal functions.?

Minister for Justice and Equality (Deputy Alan Shatter): I am informed by the Garda authorities that the incident referred to was the subject of investigation by An Garda Síochána, which resulted in the submission of an investigation file to the law officers, who directed that a person be charged with manslaughter and assault. At the ensuing trial directions to acquit were given by the judge. Following the publication of an article concerning this case in October, 2010, representations were made requesting an investigation of the matters raised in it. I understand that the Commissioner arranged for a Detective Superintendent to meet the author of the article and the persons making the representations to make an assessment of whether there was any evidence which was not available to the original investigation team and if further investigation was required in this case. As a result, a number of lines of inquiry were identified for examination by An Garda Síochána.
