More than 700 complaints were from former residents of the Christian Brother institutions. They ran six industrial schools: Artane (1870-1969) for 825 boys; St Joseph’s in Tralee (1870-1970) for 140 boys; St Joseph’s in Salthill, Galway (1871-1995); St Joseph’s in Glin, Limerick (1966-1972); St Joseph’s in Letterfrack˜ (1887-1974) for 165 boys; and Carriglea Park in Dún Laoghaire. They also ran St Joseph’s School for the Deaf in Cabra.
Sex abuse was a ‘chronic problem’ in their institutions, and steps taken by the Brothers to avoid scandal protected perpetrators. Offenders were transferred to avoid detection. Safety of children was not a priority, physical punishment was excessive and led to a climate of fear amongst the boys.
There were three abusers in Letterfrack at the same time, two were present there for periods of 14 years.
St Joseph’s in Tralee was ‘a secret enclosed world, run in fear’. Brothers with a known propensity for sex abuse were sent to Glin, indicating indifference to children’s needs."?

In his conclusion, Mr Justice Kelly stated:

It is no exaggeration to characterise what has gone on a scandal. I have had evidence of inter-departmental wrangles over demarcation lines going on for months, seemingly endless delays in drafting and redrafting legislation, policy that appears to be made only to be reversed and a waste of public resources on. For example, going through an entire planning process for the Portrane development only for the Minister to change his mind, thereby necessitating the whole process being gone through again. The addressing of the rights of the young people that I have to deal with appears to be bogged down in a bureaucratic and administrative quagmire. I have come to the conclusion that the response of the Minister to date falls far short of what this Court was reasonably entitled to expect concerning the provision of appropriate facilities for young people with difficulties of the type with which I am dealing.42"?

Most of the children and young people that come before the courts, come from a disadvantaged background and have a negative perception of school.

There are serious questions as to whether prison is the proper place for people so young. A large number of children (aged between 16-18) are imprisoned in adult prisons in St. Patricks Institution; this is actually in contravention of Ireland’s obligations under the UN Convention on the Rights of the Child.

The Department of Justice and Equality: Minister Shatter publishes Inspector of Prisons Report on St Patrick’s Institution, and Visiting Committee Reports for 2011 for Dóchas Centre, Midlands, Limerick, Shelton Abbey, Training Unit, Castlerea, Loughan House and Portlaoise Prisons: "The report raises serious issues and major concerns relating to St Patrick’s Institution. In a wide ranging and comprehensive report, the Inspector has reported that a combination of, inter alia, weak management, the culture in the prison, the inattention to human rights norms, prisoners on protection and prevalence of drugs means that St Patrick’s has not lived up to the mission statement of the Irish Prison Service. He concluded that there has been a culture in St Patrick’s which resulted in the human rights of some prisoners (children and young adults) being either ignored or violated.
Major concerns have been raised in relation to aspects of prison healthcare, education, the use of special cells for safety and close supervision, inadequate record keeping, the use of control and restraint techniques contrary to established guidelines and international best practice. According to Minister Howlin political reform is still high on the agenda « politicalreform.ie: "We remain in the dark as to how this Constitutional Convention will be constituted.  All the Minister would say is that “Currently, the two parties in Government are discussing the modus operandai of the convention and will publish proposals”.  This has been left deliberately vague.  In its manifesto, Labour had said that it would comprise one-third politicians, one-third legal experts and one-third citizens, whereas Fine Gael’s preference was for a citizens’ assembly (i.e. with 100% of its members being ordinary citizens) focused specifically on the question of the electoral system.  It will be interesting to see which way the government jumps.  Perhaps there is a middle way that combines both approaches?"
