WHAT IF?

WHAT IF?: For Christy - being a runner was not simply just about escaping - it was about, despite the systematic abuse that reigned in these institutions, about never giving up - never letting the authorities break you down.?

ENCOURAGECHANGE.: February 2012

ENCOURAGECHANGE.: February 2012: Chief Justice Susan Denham said. The person authorising a search warrant is required to be able to assess the conflicting interests of the State and the person whose home is to be searched, the judge said. In this case, the detective superintendent was not independent, she added. Article 40.5 of the Constitution expressly provides that one’s home is inviolable and shall not be forcibly entered except in accordance with the law, she said. This meant entry had to be effected “without stooping to methods which ignore the fundamental norms” of the legal order as contained in the Constitution.?

WHAT IF?

WHAT IF?: Shortly afterwards the judiciary was convulsed by the Sheedy affair, which led to the resignation of a Supreme Court and a Circuit Court judge, and it appeared a system for regulating judicial conduct was imminent. Over a decade later nothing has been done, despite a further report from a committee chaired by then chief justice Ronan Keane and including Mrs Justice Denham. It recommended the setting up of a judicial council on a statutory basis, providing for the representation, education and training of judges as well as a disciplinary mechanism. This has still to be legislated for, though the last government published the heads of a Judicial Council Bill last year and it features in the programme for government.?GARDA COMPLAINTS BOARD CHAIRMAN SUSAN DENEHAM,FRANK SMYTH,CHIEF SUPT.JAMES P O SULLIVAN,ABUSE OF AUTHORITY AGAINST PROFOUNDLY DEAF PERSONS,STRIP SEARCHING.DECISION?AN INCLUSIVE SOCIETY?

That evening McCabe visited Chief Superintendent Joe McGovern at his home, where he made “certain limited admissions”. He had been staying in a house belonging to the chief superintendent. The chief superintendent brought these “admissions” to the local parish priest rather than gardaí. Copies of the abused boy’s statement were made available to church authorities.?
